MeFleet Membership Agreement

  1. Introduction
    1.                 Welcome to MeFleet! MeFleet provides a membership service (the "MeFleet Service") that delivers to MeFleet Members:
      1.           the benefits of group buying power in order to deliver discounted costs and discounts on goods and services;
      2.           special offers and promotions from time to time; and
      3.           a convenient one-stop-shop approach to managing your vehicle or vehicles.
    2.                 By becoming and continuing to be a MeFleet Member, you agree to be bound by the terms and conditions of this MeFleet Membership Agreement.
    3.                 In this MeFleet Membership Agreement, unless a contrary intention appears or the context requires otherwise, capitalised terms have the meanings given in the MeFleet Membership Agreement and:
      1.           "Additional Service Terms" means the terms and conditions set out in clause 19 that apply to any Additional Services.
      2.           "Additional Services" means the additional services that MeFleet Members may acquire from time to time as part of their MeFleet Membership.  These may include third party products and services.
      3.           "Australian Consumer Law" means the Australian Consumer Law set out at Schedule 2 to the Competition and Consumer Act 2010 (Cth).
      4.           “Direct Debit Request” means a request by you for a direct debit from your chosen account or accounts.
      5.           "MeFleet " means MeFleet Pty Ltd (ABN 65 609 722 778), an Australian owned and operated company, with its registered office located at G07, 566 St Kilda Rd Melbourne VIC 3004.
      6.           "MeFleet Member", "you" and “I” mean a person or organisation who is a member of the MeFleet Service, subject to this Membership Agreement, for so long as the member continues to pay to MeFleet the Membership Fees and any other applicable fees and charges and “my”, "your" and "yours" means "the MeFleet Member's".
      7.           "MeFleet Membership" means membership as a MeFleet Member.
      8.           "MeFleet Membership Agreement" means this MeFleet Membership Agreement as varied from time to time by MeFleet and as amended or supplemented from time to time by any Voucher issued by MeFleet. The MeFleet Membership Agreement includes such Additional Service Terms as may apply, depending on which Additional Services you acquire from time to time.
      9.           "MeFleet Website" means mefleet.com.au.
      10.        "Membership Fees" means the fees and charges that you must pay from time to time in accordance with this MeFleet Membership Agreement to remain a MeFleet Member.  The Membership Fees are published on the MeFleet Website and may be varied at any time by MeFleet. MeFleet will notify MeFleet Members of any changes to the Membership Fees in accordance with this MeFleet Membership Agreement.
      11.        "Related Body Corporate" has the meaning given in the Corporations Act 2001 (Cth).
      12.        "Related Entities" means MeFleet's Related Bodies Corporate and all of the directors, officers and employees of MeFleet and its Related Bodies Corporate.
    4.                 In this MeFleet Membership Agreement, unless a contrary intention appears or the context requires otherwise, the words “include”, “includes” and “including” are not terms of limitation and are to be read as “include”, “includes” or “including” (as applicable) without limitation.
  2. Membership
    1.                 To be a MeFleet Member, you must provide one or more current, valid, acceptable methods of payment, which you may update from time to time ("Payment Method”). You authorise MeFleet to charge your Payment Method for your Membership Fees on a per vehicle basis, along with any other charges that you may incur or authorise from time to time.
    2.                 Your MeFleet Membership will continue month-to-month until terminated. Membership Fees will be charged on the individual monthly renewal dates of each vehicle or subscription. You can find specific details regarding your MeFleet Membership and any subscriptions or other purchases you have made by visiting the MeFleet Members’ area of the MeFleet Website.
    3.                 You are responsible for all activity that occurs under your MeFleet Membership.  You agree to maintain the security and secrecy of your MeFleet Membership number, username and password at all times.
  3. Vouchers
    1.                 From time to time, MeFleet may provide MeFleet Members with promotion codes that supplement or vary this MeFleet Membership Agreement (a "Voucher"). Vouchers may be provided:
      1.           to new MeFleet Members to try the MeFleet Service;
      2.           for the purposes of allowing MeFleet to track the success of targeted membership campaigns; or
      3.           for any other reason that MeFleet in its sole discretion sees fit.
    2.                 Vouchers may be time limited.  If so, once a Voucher expires, MeFleet Members revert to standard pricing and to the standard terms of the MeFleet Membership Agreement, unless you cancel your MeFleet Membership before expiry of the Voucher period.
    3.                 MeFleet Members may view information regarding Vouchers by visiting the MeFleet Website or contacting MeFleet for assistance. You will not receive a notice from MeFleet that any particular Voucher period has expired.
    4.                 MeFleet may, at its sole discretion, create Vouchers that may be redeemed for MeFleet Membership credit, or for other features or benefits related to the MeFleet Services and/or a third party provider’s goods or services that may be subject to any additional terms that MeFleet applies to that Voucher. You agree that Vouchers:
      1.           must be used for the intended purpose, and in a lawful manner;
      2.           may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public forum or otherwise), unless expressly permitted by MeFleet;
      3.           may be terminated, cancelled or suspended by MeFleet at any time without notice, for any reason and without liability to MeFleet;
      4.           may only be used pursuant to the specific terms that apply to that Voucher as notified by MeFleet;
      5.           are not redeemable or valid for cash; and
      6.           may expire prior to your use.
    5.                 MeFleet reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Vouchers by you or any other user in the event that MeFleet determines or believes that the use or redemption of the Voucher was in error, fraudulent, illegal, or in violation of the applicable voucher terms or this MeFleet Membership Agreement.
  4. Billing
    1.                 Membership Fees are charged on a per vehicle, per service basis.
    2.                 Membership Fees are payable monthly in advance and are generally calculated and billed on the date in each month following the first month that corresponds with the date your MeFleet Membership commenced. In some cases the timing of your billing may change, for example if payments are not successfully settled.
    3.                 On successful completion of your MeFleet Membership registration, you will be charged your first month’s Membership Fee, which is non-refundable.
    4.                 Purchases from MeFleet will be invoiced by MeFleet according to the terms of that particular purchase, which can be found in the MeFleet Members’ area of the MeFleet Website.
    5.                 While transaction information is available within the MeFleet system, MeFleet can email Tax Invoices to you on request. You may request a maximum of one Tax Invoice per month for your MeFleet Membership.
    6.                 Purchases made directly from MeFleet third party suppliers will be invoiced to you by the relevant supplier in accordance with their trading terms and with no involvement from MeFleet.
  5. Payment Methods
    1.                 MeFleet encourages you to register both credit card and direct debit details for use as your Payment Methods. Direct debit services are provided to you by Ezidebit Pty Ltd ACN 096 902 813 (“Ezidebit”).  By registering for a direct debit payment method, you are agreeing to the terms and conditions of Ezidebit’s service agreement as available from the MeFleet Website.
    2.                 MeFleet may (at its discretion) utilise any of your available Payment Methods for particular transactions. MeFleet will endeavour to use your nominated default payment method where possible.
    3.                 In order to keep costs down and to provide better discounts to all MeFleet Members, MeFleet reserves the right to charge MeFleet Members for transaction fees levied on it when processing payments.
    4.                 In the event of a failed payment using one Payment Method, you authorise MeFleet to use another of your registered Payment Methods to make a payment.
    5.                 If a payment is not successfully settled, due to payment method expiry, insufficient funds, or otherwise, MeFleet may suspend your access to the MeFleet Service until you provide MeFleet with a valid Payment Method.
    6.                 Any costs associated with an unsuccessful payment will be borne by you. MeFleet may charge a processing fee of up to $15.00 ("Failed Payment Administration Fee"), which will be payable in the event of a failed payment. The Failed Payment Administration Fee has been calculated by MeFleet to allow MeFleet to recover its reasonable administrative and overhead costs associated with a failed payment. You acknowledge that the Failed Payment Administration Fee is reasonable and is not a penalty. You release MeFleet and its Related Entities from any claim that the Failed Payment Administration Fee is not reasonable or that you are not liable to pay such fee, whether on the basis that it is unenforceable as a penalty or otherwise.
    7.                 In addition to levying the Failed Payment Administration Fee, any out of pocket costs and expenses incurred by MeFleet in connection with a failed payment, including debt recovery costs, will also be chargeable to and payable by you.
    8.                 You remain responsible for any uncollected amounts and authorise MeFleet to continue billing the Payment Method as it may be updated. This may result in a change to your payment billing dates.
    9.                 For certain Payment Methods, the issuer of your Payment Method may charge you other fees and charges, such as transaction fees or charges, which you are responsible for paying. Check with your Payment Method service provider for details.
  6. Cancellation
    1.                 You can cancel your MeFleet Membership at any time by following the instructions on the MeFleet Website. MeFleet does not provide refunds or credits for any partial-month MeFleet Membership periods. If you cancel your MeFleet Membership, MeFleet will endeavour to close your MeFleet Membership within the current billing period subject to you providing no less than 10 Business Days' notice.
    2.                 Fuel cards and other services will be disabled as part of the MeFleet Membership closure process. You remain liable for any usage of these services until successful disablement of those services. No refund will be made in respect of unused services paid in advance.
    3.                 During your MeFleet Membership, you may have entered into contracts with certain MeFleet third party suppliers (eg. a finance company for the purposes of financing a vehicle). These separate contracts will generally be independent from your MeFleet Membership and will not be affected by cancellation of your MeFleet Membership. Any contracts that are dependent on your MeFleet Membership status will have this noted in the relevant contract terms in this Agreement. Importantly, you may not be entitled to renew these arrangements if you are no longer a MeFleet Member.
  7. Changes
    1.                 MeFleet may change the price or other terms of the MeFleet Service (including the terms and conditions of this Membership Agreement) from time to time.
    2.                 Any such price changes will apply to you no earlier than 30 days following our notice to you.
  8. The MeFleet Service
    1.                 You must be 18 years of age or over to become a MeFleet Member. Minors may only use the service under the supervision of an adult.
    2.                 MeFleet Membership is charged on a per vehicle basis. Individual payments are required for each vehicle that is to receive any of the MeFleet benefits.
    3.                 MeFleet takes all reasonable care in providing the MeFleet Service but to the extent permitted by law, does not warrant that any data or information MeFleet provides is accurate or that MeFleet will provide all the information you need to answer all your questions. You should independently validate any of the information that MeFleet may provide you.
    4.                 Further information about any service offerings can be obtained by contacting MeFleet or the service provider of the product or service and identifying yourself as a MeFleet Member. All third party product and service details, rates, terms, conditions and other information are subject to change at any time without notice.
    5.                 In providing the information on the MeFleet Website, MeFleet has not taken your financial circumstances, needs or objectives into account. You should consider these things and make your own mind up as to whether any product or service offered by MeFleet or any of its third party providers is suitable for you before making any decisions.
    6.                 MeFleet Membership and the information provided by MeFleet is not intended to be financial or legal advice. MeFleet provides information only and does not make any recommendations as to the suitability of any service or product to your specific needs. MeFleet does not suggest or recommend that you apply for any particular credit or insurance contracts with any particular credit or insurance provider.
    7.                 To find out more information about the MeFleet Services or if you need assistance with your MeFleet Membership, please visit the MeFleet Website and use the appropriate contact information.
    8.                 If any provision or provisions of this MeFleet Membership Agreement is or are held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions will remain in full force and effect.
    9.                 MeFleet may, from time to time, change this MeFleet Membership Agreement and the MeFleet Services. Membership is always subject to the most current terms and conditions.
  9. MeFleet will not provide you with credit assistance
    1.                 MeFleet is a finance and insurance intermediary. MeFleet does not conduct any assessment of you for credit or insurance worthiness. MeFleet will not provide you with any advice as to whether any of the offers on the MeFleet Website are suitable for your personal financial circumstances and needs. MeFleet will not provide you with 'credit assistance' as defined by the National Consumer Credit Protection Act. MeFleet’s role is limited to providing you with information about and introduction to loans which may be offered to you by participating lenders. From time to time, MeFleet may inform you of offers by various participating lenders and their representatives which may be made available to MeFleet Members.
    2.                 MeFleet Membership does not entitle you to receive any offer. Where an offer is made it will not be an offer of credit or insurance (you will have to apply for and be approved for this independently). MeFleet makes no representation that you will be eligible for the offers available on the MeFleet Website or that any particular participating lender/insurer will agree to make finance/insurance available to you.
  10. Commissions
    1.             MeFleet may earn a commission or fee when MeFleet Members purchase a product or service. Commissions or fees are generally volume based, vary from time to time and contribute toward the low fees and quality service that MeFleet is able to offer to MeFleet Members.
  11. MeFleet Platform, On-Line Tools and Quotations
    1.             The finance and insurance price indicators and related information (“Finance and Insurance Tools”) found on the MeFleet Website are offered solely to provide indications of price and are not quotations or offers of any kind. You agree not to compile, repackage or disseminate for any purpose, any information provided or obtained by you as a result of your use of the Finance and Insurance Tools without the prior written consent of MeFleet. MeFleet reserves the right to terminate your access to these MeFleet Services in its sole discretion, including for submitting excessive requests for these MeFleet Services.
    2.             Any quotations or other information exchanged using the Finance and Insurance Tools and the MeFleet Website are between the parties exchanging that information. The role of MeFleet regarding finance, insurance and other products is as an intermediary and communication facilitator. To the extent permitted by law, MeFleet is not responsible for any offers made by MeFleet third party suppliers or for any acceptance by MeFleet Members of such offers.
    3.             While MeFleet has undertaken reasonable steps to ensure that the Finance and Insurance Tools and any information provided by or through them are materially accurate and materially free from defects, to the extent permitted by law:
      1.        MeFleet does not warrant the accuracy, adequacy, correctness or completeness of this information or these features; and
      2.        these features are provided on the basis that they are non-binding estimates and do not take account of your particular circumstances.
    4.             The information contained on the MeFleet Website is for general information purposes only. You must not rely on any statement contained on the MeFleet Website without taking specialist advice that takes into account your specific circumstances. To the extent permitted by law, MeFleet makes no warranties and accepts no responsibility for any loss or damage you may suffer as a result or your reliance on any of the information.
    5.             You may not:
      1.        remove any copyright, trademark or other proprietary notices from the MeFleet Website or any MeFleet publications or documents, or from any portion of them;
      2.        reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the MeFleet Services except as expressly consented to in writing by MeFleet;
      3.        decompile, reverse engineer or disassemble the MeFleet Website or any of the MeFleet Services;
      4.        link to, mirror or frame any portion of the MeFleet Website or any of the MeFleet Services;
      5.        cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the MeFleet Website or any of the MeFleet Services or unduly burdening or hindering the operation and/or functionality of any aspect of the MeFleet Website or any of the MeFleet Services; or
      6.        attempt to gain unauthorized access to or impair any aspect of the MeFleet Website or any of the MeFleet Services or any systems or networks of MeFleet, of any of its Related Entities, or of any third party providers.
  12. Services
    1.             MeFleet may at any time change the MeFleet Website, the MeFleet Services and its goods and services providers, including by varying existing services and products, introducing new services and products or removing, cancelling, discontinuing or suspending existing services and products.
    2.             MeFleet is under no obligation to MeFleet Members in relation to continuing the particular services and products offered at any time and MeFleet Members may cancel their MeFleet Membership at any time in accordance with this MeFleet Membership Agreement should they become dissatisfied with the service mix.
    3.             MeFleet Members agree to use the MeFleet Services, including all associated features and functions, in accordance with all applicable laws, rules and regulations. You agree that the MeFleet Services and the MeFleet Website are subject to MeFleet's reasonable use policies as determined by MeFleet and that MeFleet may refuse or suspend any MeFleet Membership, for any reason and at any time, at the sole discretion of MeFleet.
    4.             When a MeFleet Member acquires any third party goods or services listed by MeFleet, the MeFleet Member is contracting directly with the relevant third party supplier on the terms of supply provided by the third party supplier.  Where a MeFleet Member acquires goods or services directly from the relevant third party service provider, MeFleet excludes and limits is liability in respect of such goods or services as described in clause 16.3.
  13. Privacy
    1.             The MeFleet Privacy Policy (www.mefleet.com.au/privacy) sets out how MeFleet will use your information. By using the MeFleet Website, registering your interest with MeFleet, contacting MeFleet or being a MeFleet Member, you consent to MeFleet handling and processing your information as described in the MeFleet Privacy Policy.
    2.             You further consent to MeFleet and its suppliers sharing data regarding your vehicle and membership in order to facilitate the provision and reporting of the services.
    3.             You give MeFleet permission to share your information and communications with third party service providers in order to facilitate repairs and other services. You also give MeFleet permission to refer to and share with others, your instructions and any correspondence MeFleet has with you to resolve any disputes that may arise in connection with your use of our services.
    4.             Personal information (including payment information) may be held by MeFleet’s chosen payment providers and in such cases the relevant provider’s privacy policies will apply.  The privacy policies of MeFleet’s current chosen payment providers can be obtained from the following websites:

    5.             You consent to MeFleet disclosing information you provide to its third party payment providers for the purposes of MeFleet processing your payments and you consent to those providers accessing, using, storing and disclosing such information in accordance with their applicable privacy policies.
  14. Passwords and Account Access
    1.             You must maintain control over your account details and prevent anyone from accessing your MeFleet account.  MeFleet Members must not reveal their password or provide access to their associated email address to anyone. MeFleet Members are responsible for updating and maintaining the accuracy of the information provided to MeFleet relating to member accounts.
    2.             You should not respond or reply to any communication requesting you to submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. MeFleet will never request your payment details via email or telephone.  You should always use our secure web site to provide this information.
    3.             Always access your sensitive account information by going directly to the MeFleet Website and not through a hyperlink in an email or any other electronic communication, even if it looks official. MeFleet may terminate your account or place your account on hold in order to protect you, MeFleet or our partners from identity theft or other fraudulent activity.
  15. Communication

You authorise MeFleet to send you information relating to your account (eg. payment authorisations, changes in password or Payment Method, confirmation messages) as well as notices and marketing messages in electronic and/or hard copy form to the addresses you provide.  MeFleet will always provide you with the ability to opt out of marketing communications if you wish to do so.

  • Warranties and Liability
    1.             To the extent permitted by law:
      1.        the MeFleet Service is provided "as is" and without any warranty; and
      2.        except to the extent provided in clause 16.2, none of MeFleet or its Related Entities accept any liability to you arising out of or in connection with the MeFleet Service or this Membership Agreement.
    2.             To the extent permitted by law, MeFleet and its Related Entities limit their aggregate liability to you arising out of or in connection with the MeFleet Service or this Membership Agreement for all claims however they arise, whether in contract, in tort (including negligence), for breach of statute or otherwise, to the value of all Membership Fees paid by you to MeFleet in the three months before any claim arises.
    3.             To the extent permitted by law and subject to clause 16.4:
      1.        none of MeFleet or its Related Entities accept any liability for or in respect of any goods or services provided by any third party; and
      2.        such goods and services are provided solely under and in accordance with the relevant third party provider's terms and conditions.
    4.             MeFleet will provide you with reasonable assistance with any issues arising from the failure of a third party provider of goods or services to provide goods or services to a reasonable standard.
    5.             To the extent permitted by law, MeFleet and its Related Entities exclude all liability to you arising out of or in connection with the MeFleet Service or this Membership Agreement for or in respect of any indirect or consequential loss or damage however arising, whether in contract, in tort (including negligence), for breach of statute or otherwise, including loss of profit, loss of revenue, loss of opportunity and loss of bargain, in each case whether actual or anticipated.
    6.             Without limiting clauses 16.1 to 16.5, in no circumstances will MeFleet or any of its Related Entities be liable to you for any loss or damage of whatever nature, howsoever arising, from or in connection with:
      1.        the use of or access to, or any inability to use or access, the MeFleet Website, the MeFleet Services or any material on the MeFleet Website;
      2.        unauthorised access to or alterations of your data or your communications with MeFleet utilising the MeFleet Website or otherwise;
      3.        any representations, statements or conduct of any third party; or
      4.        any goods or services purchased through the MeFleet Website.
    7.       If any consumer guarantee under Division 1 of Part 3-2 of the Australian Consumer Law ("Consumer Guarantee") applies to any goods or services provided by MeFleet to you under this MeFleet Membership Agreement, then subject to clause 16.8, MeFleet limits its liability for failure to comply with a relevant Consumer Guarantee:
      1.        in relation to goods, to one or more of the following (at MeFleet's election):

          (a)   the replacement of the goods or the supply of equivalent goods;

          (b)    the repair of the goods;

          (c)   the payment of the cost of replacing the goods or of acquiring equivalent goods;

          (c)    the payment of the cost of having the goods repaired; and

      2.        in relation to services, to one of the following (at MeFleet's election):

          (a)   the supplying of the services again;

          (b)   the payment of the cost of having the services supplied again.

    8.        Clause 16.7 does not apply:
      1.        to goods or services that are of a kind ordinarily acquired for personal, domestic or household use or consumption; or
      2.        in relation to goods, to the Consumer Guarantees under sections 51 (guarantee as to title), 52 (guarantee as to undisturbed possession) or 53 (guarantee as to undisclosed securities etc.) of the Australian Consumer Law.
    9.        None of clauses 16.1 to 16.8 exclude, restrict or modify the application of any Consumer Guarantee to the extent that such exclusion, restriction or modification is not permitted by the Australian Consumer Law.

  • Governing law
  • This MeFleet Membership Agreement will be governed by and construed in accordance with the laws of Victoria, Australia.

  • Additional Service Terms
    1.             Fuel Cards
      1.        MeFleet Members may apply for a Caltex StarCard fuel card (“Fuel Card”).  The Fuel Card is provided to you by Caltex Australia Petroleum Pty Ltd ABN 17 000 032 028 and its subsidiaries and related or associated companies.
      2.        If you elect to acquire a Fuel Card through MeFleet, you agree to pay a deposit ("Fuel Card Deposit") in an amount nominated by MeFleet to be held by MeFleet or its agent which may be applied to any sums owed or payable by you in connection with the Fuel Card.
      3.        The Fuel Card Deposit is fully refundable upon termination or expiry of the Fuel Card as long as there are no outstanding payments due.
      4.        Should a payment fail to settle, MeFleet may deduct the outstanding amount from the Fuel Card Deposit at its discretion.
      5.        You are not entitled to retain or continue use of the Fuel Card if your MeFleet membership is terminated or not in good standing as determined by MeFleet at its sole determination.
      6.        MeFleet Members are responsible for the security of their Fuel Card and for any use of the Fuel Card until such a time as the MeFleet Member advises MeFleet to suspend or cancel the card and reasonable time to complete the request has passed (giving additional allowance for requests made outside of normal business hours).
      7.        A transaction fee may be added to each usage of the Fuel Card to cover the cost of processing, subject to prior notification to the MeFleet Member.
      8.        MeFleet may cancel or temporarily suspend any Fuel Card at its discretion, particularly when MeFleet believes there is a problem with payment.

    2.             Refer-a-Friend
      1.        The terms of the Refer-a-Friend discount system will be as determined and may be changed by MeFleet at any time in its absolute discretion.  These may include additional discounts on third party products and services, for example, an added fuel discount.
      2.        MeFleet will determine whether (and if at all) it will transfer all or some prior referrals to any new or updated system at its sole discretion.
      3.        MeFleet is under no obligation the previous recipients of any benefits under this service to continue those benefits in any way whatsoever.
      4.        A referral is nullified if:

          (a)   a referred friend removes or requests MeFleet to remove the referral code from their login (even though they remain a MeFleet Member); or

          (b)    a referred friend ceases their MeFleet Membership.

      5.        Refer-a-Friend fuel discounts are calculated based on the number of people that have been accepted by MeFleet for MeFleet Membership using your referral code and who remain a MeFleet Member for longer than 31 days.
      6.        Refer-a-Friend discounts for fuel will only apply to a maximum of 150 litres purchased by the referring MeFleet Member per week (Monday to Sunday). Thereafter only the basic discount applies (ie. the Refer-a-Friend component of the discount is ignored). Any unused balance does not carry forward and is forgone each week that it is not used.
    3.             Roadside
      1.        MeFleet Roadside Assistance is sold as a 1 year subscription, paid in advance. MeFleet Members purchase this product directly from MeFleet and must maintain their MeFleet Membership in order to receive MeFleet Roadside Assistance.
      2.        Once paid, the subscription is valid for 1 year and payment is not refundable for any reason. The subscription will automatically renew annually until cancelled by you.
      3.        The NRMA Business Wise terms and conditions also apply as relevant to your usage of MeFleet Roadside Assistance.     4.             Accident Management
      1.        The Accident Management service is sold as either a monthly subscription or as a per-incident service. MeFleet Members purchase this product directly from MeFleet and must maintain their MeFleet Membership in order to receive the Accident Management service.
      2.        Once paid, the subscription is valid for 1 month and payment is not refundable for any reason. The subscription will automatically renew monthly until cancelled by you.
      3.        The activities that are to be carried out under this service are outlined in the Accident Management Product Guide available from the MeFleet Members' area of the MeFleet Website.
      4.        MeFleet makes no representation that any saving or any other particular result will be achieved through the use of this service.
      5.        Each vehicle that is requested to be assessed by the MeFleet Member will incur an additional fee as published on the MeFleet Website and as varied by MeFleet in accordance with this MeFleet Membership Agreement.
      6.        This service is provided on a commercially reasonable basis with regard to the amount of effort that will be invested in a particular incident.
      7.        MeFleet makes reasonable efforts to ensure that MeFleet Members provide pre-authorisation of any work to be carried out before those costs are committed or incurred. However, any reasonable costs that are incurred or committed (such as authorisation of emergency towing) are to be borne by the MeFleet Member as long as MeFleet and subcontractors were acting reasonably and in good faith.
    5.             MeFleet Expert Advice
      1.        Expert Advice is sold as a monthly subscription paid in advance. You are purchasing this product directly from MeFleet and must maintain your MeFleet Membership in order to receive Expert Advice.
      2.        Once paid, the subscription is valid for 1 month and payment is not refundable for any reason. The subscription will automatically renew monthly until cancelled by you.
      3.        Mechanically qualified employees and/or subcontractors provide only general advice over the telephone based on information provided by the MeFleet Member.
      4.        At all times, the MeFleet Member remains the decision maker who is responsible for any action (or inaction) taken regarding the MeFleet Member's vehicle.
    6.             Grey Fleet
      1.        MeFleet defines Grey Fleet as “drivers and their personal vehicles that are being used for work purposes.”
      2.        A separate agreement is available that will be tailored to the particular requirements of any MeFleet Member seeking the assistance of MeFleet to manage their Grey Fleet.
    7.             Vehicle Buying
      1.        Vehicle Buying is sold as either a basic or concierge service. You are purchasing this product directly from MeFleet and must maintain your MeFleet Membership in order to receive the Vehicle Buying service.
      2.        The activities that are to be carried out under this service are outlined in the Vehicle Buying Product Guide available from the MeFleet Members' area of the MeFleet Website.
      3.        MeFleet will engage with its preferred dealer network where it has already built relationships to obtain fast, economical quotations on behalf of members.
      4.        MeFleet does not (and cannot) represent that its price will be the cheapest available in the market. There will always be a car dealer who will discount further in order to win business depending on their local circumstances.
    8.             MeFleet Advantage
      1.        MeFleet Advantage allows you to purchase eGift cards for redemption via the Unified Incentives Pty Ltd (ABN 53 157 818 427) online portal, known as GiftPay (egiftpost.com).
      2.        eGift card fulfillment is the responsibility of Unified Incentives Pty Ltd.
      3.        eGift cards will be emailed to your nominated MeFleet Membership email address as confirmed at time of your order. You should keep this email safe as it is easily redeemable by anyone in possession of the email. MeFleet is not responsible for any loss that may be incurred as a result of your failure to protect emailed eGift cards.
      4.        Terminating your MeFleet Membership has no effect on any unused eGift cards.
      5.        The eGift card is not refundable or redeemable for cash for any reason.
      6.        eGift cards expire and any unused value will be lost upon expiry. Please read the GiftPay terms carefully.
      7.        The GiftPay terms and conditions apply to your usage of this service. These can be found on each eGift card that you order and are also quoted in italics as follows:

    Treat this electronic gift card (egift card) as cash. Any person who learns the URL of this egift card can use it, therefore it is your responsibility to keep this egift card safe by keeping the URL private. We recommend you keep the original egift card email safe and take all measures necessary to secure your email. Do not open this egift card on a public or shared computer terminal. Lost or stolen egift cards will not be replaced or refunded. Not redeemable for cash. When you choose to redeem your egift card by converting part or all of the value into a participating merchant's egift card or voucher, the validity of that portion of your egift card will change to a shorter period.     19.9                Point of sale contracts

    19.9.1          You purchase the following goods and services from the relevant third party provider on and subject to the third party provider’s terms and conditions, available from the third party supplier at the time of purchase by you:

    (a)           Batteries;

    (b)           Glass;

    (c)           Finance;

    (d)           Insurance;

    (e)           Rental Cars;

    (f)             Servicing and Repair;

    (g)           Tyres;

    (h)           Greenfleet;

    (i)             Car wash/detail; and

    (j)             Any other goods or services as may be determined by MeFleet from time to time.
